1. Acceptance of Terms

Welcome to the Terms of Service (these "Terms") for the website holistic.health (the "Website"), and related mobile applications (the "App") operated by Holistic Health Inc. ("Company," "we," or "us"). The Website and any content, tools, features and functionality offered on or through our Website and the App are collectively referred to as the "Services."

These Terms govern your access to and use of the Services. Please read these Terms carefully, as they include important information about your legal rights. By accessing and/or using the Services, you are agreeing to these Terms. If you do not understand or agree to these Terms, please do not use the Services.

2. Who May Use the Services

You must be 18 years of age or older to use the Services. By using the Services, you represent and warrant that you meet these requirements. The Services are not intended for emergencies, pediatric emergencies, or serious health concerns requiring immediate medical attention.

3. Nature of Services

Holistic Health is an AI wellness companion, not a licensed healthcare provider.It does not practice medicine, provide medical diagnoses, or offer medical advice or patient care. Our AI is designed to provide wellness education, lifestyle guidance, and support based on holistic health principles.

Our network of holistic practitioners (Traditional Naturopaths, Functional Nutritionists, Integrative Health Coaches) provide education and wellness coaching, not medical treatment. They are not licensed physicians and do not diagnose or treat medical conditions.

Important: Always consult with a licensed healthcare provider for medical concerns. The information provided through our Services should not replace professional medical advice, diagnosis, or treatment.

4. Emergency Services

Holistic Health is NOT for emergencies. If you believe you are experiencing a medical emergency, please immediately call 911 or your local emergency services. If you are experiencing thoughts of self-harm or suicide, please contact the Suicide & Crisis Lifeline at 988.

5. Accounts and Identification

No account, email address, or app is required to use the Services. Your guide works over Messages: texting your guide uses your mobile number and stores your message history so the guide can respond, remember context, and follow up. See our Privacy Policy for how conversations are handled and retained.

Members who created a web account (with an email address) before the guide moved to Messages keep access to that account and its wellness history. If you have a legacy account, you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

6. Fees and Payment

AI wellness consultations and our practitioner directory are free. Practitioner consultation fees vary by practitioner and are listed on their profile pages. Payment for practitioner services is arranged directly between you and your chosen practitioner.

7. Text Messaging

Our guide communicates with you by text message over iMessage, RCS, and SMS. By starting a text conversation with us, or by replying to confirm when we ask, you give your prior express consent to receive text messages from Holistic Health at the mobile number you used, including automated messages and any proactive check-ins you opt into.

• Message frequency varies. Proactive check-ins are limited to about one per week at most, and only after you opt in.
• Message and data rates may apply from your mobile carrier.
• Reply STOP at any time to end all messages — we honor STOP immediately and permanently. Reply HELP for help.
• Consent to receive texts is not a condition of using the Services or of any purchase.
• Message delivery is not guaranteed; carriers and messaging providers (your carrier, Apple, Google) are not liable for delayed or undelivered messages.
• Standard SMS and RCS messages are not end-to-end encrypted. See our Privacy Policy for how we handle your number and messages.

8. Privacy and Data

We take your privacy seriously. Please review our Privacy Policy to understand how we collect, use, and protect your information.

• We follow industry-standard security practices for stored health information
• We do not sell your personal information, and we do not share your conversations for third-party advertising
• To operate and improve the Services, your conversations are processed by us and by the third-party AI providers that power your guide, under confidentiality and data-protection agreements
• Texting requires your mobile number, so those conversations are not anonymous; no account or email is required
• Our marketing website uses cookies for analytics and ad measurement according to your consent choices (see Privacy Policy → Cookies, Analytics & Advertising). Advertising platforms never receive your health information, your phone number, or your conversations
• If your first text includes a website invite code, we use it only to record which referral source brought you; it never affects your care

9. Intellectual Property

The Services and all content, features, and functionality are owned by Holistic Health Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

THE WELLNESS INFORMATION PROVIDED THROUGH OUR SERVICES IS FOR EDUCATIONAL PURPOSES ONLY AND SHOULD NOT BE CONSIDERED MEDICAL ADVICE. ALWAYS SEEK THE GUIDANCE OF A QUALIFIED HEALTHCARE PROVIDER FOR MEDICAL CONCERNS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOLISTIC HEALTH INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.

12. Dispute Resolution

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to participate in class actions or class arbitrations.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our Website with a new "Last updated" date. Your continued use of the Services after such changes constitutes acceptance of the updated Terms.
